Law Enforcement Guidelines

This page explains how VyByN LLC responds to requests from law enforcement and other government agencies for user information. It is intended for officers and agencies, but it is public so that our users can see how we handle their data.

1. Where to send a request

All requests must be sent to legal@vybyn.app from an official government email address, on official letterhead, and must identify the requesting officer and agency, a direct contact, and the legal authority relied on.

We do not accept service of legal process by phone or through in-app support. We are not able to act on requests that do not identify the requesting agency.

2. What we require

Requests from outside the United States should ordinarily be made through a mutual legal assistance treaty or letter rogatory. We may respond to a properly issued foreign request voluntarily where the law permits.

3. Identifying an account

Please provide the account's email address or the user identifier. We cannot reliably identify an account from a first name, a photograph or an approximate location.

4. Preservation requests

We will preserve records for 90 days on receipt of a valid preservation request under 18 U.S.C. § 2703(f), and will extend once for a further 90 days on request while legal process is obtained. A preservation request does not disclose anything; it only prevents deletion.

5. Emergencies

Where we receive a request in good faith involving a risk of death or serious physical injury, we may disclose information without legal process, as permitted by 18 U.S.C. § 2702(b)(8). Mark the email subject EMERGENCY DISCLOSURE REQUEST and describe the nature of the emergency, the person at risk, and why the information is needed without delay.

6. Notice to users

Our policy is to notify a user before disclosing their information, so that they may seek to protect their rights, unless we are legally prohibited from doing so, or we believe on reasonable grounds that notice would create a risk of harm to a person, of destruction of evidence, or of obstruction of an investigation.

7. What we hold, and for how long

We do not retain data indefinitely, and we cannot produce what we no longer hold. Identity-verification media is deleted automatically on a short schedule, and accounts that are deleted are erased on a defined timetable. Our Privacy Policy describes what we keep and for how long. A preservation request received before deletion is the reliable way to secure records.

8. Costs and authenticity

We may seek reimbursement for the costs of responding where the law allows. We may decline a request that is overbroad, that is not properly issued, or whose authenticity we cannot verify, and we will say so rather than respond partially.
