Terms of Service

Welcome to VyByN. These Terms of Service ("Terms") govern your use of the VyByN mobile application and website (collectively, the "Service") operated by VyByN LLC ("we", "us", or "our"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use VyByN. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Account Registration

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Acceptable Use

You agree not to:

• Provide false or misleading information in your profile
• Use the Service for any unlawful purpose or to solicit others to perform unlawful acts
• Harass, abuse, or harm other users
• Post content that is hateful, threatening, pornographic, or violates any person's rights
• Use the Service for commercial purposes without our written consent
• Attempt to reverse engineer, decompile, or hack the Service
• Create multiple accounts or use automated systems to access the Service
• Impersonate any person or entity

4. Content

You retain ownership of content you post on VyByN. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Service. We may remove any content that violates these Terms.

5. Subscriptions and Payments

VyByN offers both free and paid subscription tiers. Paid subscriptions are billed through the App Store, Google Play, or Stripe. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Refunds are subject to the applicable platform's refund policy.

6. Safety

While we implement verification and safety features, we cannot guarantee the conduct of any user. You are solely responsible for your interactions with other users. We encourage you to exercise caution and good judgment when communicating with or meeting other users.

7. Termination

We may suspend or terminate your account at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users or the Service. You may delete your account at any time through the app settings.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY MATCHES WILL RESULT IN SUCCESSFUL RELATIONSHIPS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VYBYN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or by email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
